THE STATUS OF THE CONTRACT RIGHT AND JURISPRUDENTIAL REVIEW

Muslim scholars evaluate the argument of rights from a legal perspective. They emphasize the importance of human rights and explain how to address the most important contemporary issues in the light of Islamic jurisprudence. Islam makes the people responsible for their actions and all of them have equal human rights irrespective of their religion, race, or gender. All adults or sane persons have the right to make any social or financial contracts for their well-being. Only the minor or those who do not have the ability to take their responsibility are exempted from this responsibility as they are not able to fulfill the requirements of the contract. This article introduces briefly the concept of rights, human rights, and then the right of contract and its various forms in the light of Islamic jurisprudence.
